Energy Code Compliance in Massachusetts: What Developers Need to Know

If you are building multifamily in Massachusetts, energy code is not a checkbox at the end of your project. It is a cost driver that shapes your mechanical systems, your envelope, and your budget from day one.
Most developers find this out too late. Here is what you actually need to know.
Massachusetts Has Three Energy Code Tiers
Massachusetts does not have one energy code. It has three, and which one applies to your project depends on where you are building.
Base Code is the minimum standard. Very few municipalities still use it. If your project is in a town that only requires base code, you have the most flexibility in how you comply.
Stretch Code is adopted by the majority of Massachusetts municipalities. Over 300 towns and cities now require it. If you are building in Boston, Cambridge, Worcester, Springfield, or almost any mid-size town, Stretch Code applies to your project. It requires significantly better building performance than base code, which means higher-efficiency HVAC systems, tighter envelopes, and energy modeling.
Specialized Opt-In Code is the newest and most aggressive tier. A growing number of municipalities have adopted it. For larger buildings over 12,000 square feet, this code requires PHIUS (Passive House) certification, which is a fundamentally different standard than Stretch Code. If your project is in a Specialized Code town, your compliance path options narrow considerably, and the cost implications are real.
The first thing you need to know is which tier your municipality requires. The second thing is that the tier determines which compliance paths are available to you, and those paths have very different cost profiles.
What Compliance Means for Multifamily Projects
For multifamily projects, the applicable code depends on building height. Buildings with 3 stories or fewer fall under 225 CMR 22 (residential energy code). Buildings with 4 or more stories fall under 225 CMR 23 (commercial energy code). This distinction matters because the compliance paths, modeling requirements, and documentation differ between the two. In both cases, energy modeling is typically required. You cannot just follow a prescriptive checklist like you might on a single-family home.
The process looks like this:
Design phase: Your energy consultant models the building as designed, identifies which compliance path is the lowest cost, and flags any issues before permits.
Permitting: The energy model and compliance documentation get submitted with your permit application.
Construction: Your HERS rater performs inspections at key milestones, including insulation, air sealing, and mechanical rough-in.
Certificate of Occupancy: Final testing (blower door, duct leakage) and the HERS certificates are required before CO.
The entire process takes the full lifecycle of your project, from design through final inspection. It is not something you can bolt on at the end.
The Mistakes That Cost Developers Money
After working on 45+ multifamily projects in Massachusetts, I see the same mistakes repeatedly.
Starting too late. If your energy consultant is not involved until construction documents, you have already locked in decisions that limit your options. The HVAC system is spec'd, the envelope is designed, and the cheapest compliance path may no longer be available. A feasibility study during schematic design gives you the numbers to make informed decisions before anything is locked.
Wrong fuel assumptions. Many developers assume they can use gas heating and comply easily. Depending on your municipality and code tier, that assumption can cost you. Some compliance paths require electrification or make gas systems significantly more expensive to offset with other upgrades.
Treating compliance as a single line item. Energy code compliance is not one cost. It is the net result of dozens of decisions across your mechanical, envelope, and plumbing systems. The right combination of decisions can save $5 to $15 per square foot compared to the wrong combination. That is the difference between a project that pencils and one that does not.
